CONSIGNMENT AGREEMENT
THE TERMS & CONDITIONS DETAILED ON THIS PAGE ARE PART OF OUR CONSIGNMENT AGREEMENT
YOUR VEHICLE WILL NOT BE ACCEPTED ON AUCTION DAY
WITHOUT YOUR AGREEMENT.
This will confirm arrangements made for sale of the property which you are consigning to us and which
is to be sold as your agent subject to the general conditions set forth below and in the conditions of Sale.
Read carefully, this is a legal document.
WARRANTY OF OWNERSHIP
You represent and warrant that you own all rights, title and interest in the property and that you have
the right to consign said property for sale and that the same is free and clear and will be kept free
and clear of encumbrances, liens and claims of third parties.
DOCUMENTS OF TITLE:
At the time of the sale of the automobile you agree to deliver the document or certificate of title,
duty endorsed and assigned to the purchaser.
COMMISSIONS:
For our services, you agree to pay us a commission of 7 per cent of the gross proceeds of the sale,
minimum commission being $100.00. All entries are subject to a $100.00 non-refundable entry fee.
Should you sell the consigned vehicle to anyone who saw the vehicle or made a contact with you at
this auction within a period of 30 days, you will be liable for our full commission charge. Furthermore,
if you should sell this vehicle at any other auction within 30 days at the price lower than the highest
bid attained on this vehicle at this auction you will be liable for our auction commission.
NO RESERVE should you agree to consign your car with NO RESERVE price - that is that the
automobile will sell to the highest bidder, the auction commission fee is 5% with a minimum $100.00 commission.
NO ENTRY FEES APPLY TO UNRESERVED VEHICLES.
All sales must go through the office. Passed Auto's- completed after the auction will be at
the mutually agreed commission rate.
INSURANCE:
It will be responsibility to provide insurance coverage for your property at all times while it
is on the auction premises.
This coverage must include public liability and property damage to a minimum of $100,000.00.
DELIVERY OF CAR TO AUCTION SITE
Car must be delivered by noon of the day preceding the sale.
Cars must be in running order and owners must drive them to the auction block.
CONDITIONS FOR SALE:
In addition to the conditions of Sale, the following shall apply.
(a) We make no guarantee, representation or agreement with respect to the selling price of any
consigned property and no appraisal, estimate or other statement by us or our representatives
with respect to selling price of consigned property is given or may be relied upon by you as a
guarantee, representation or agreement of selling price.
(b) We reserve the right to withdraw any property at any time, before actual sale, in our sole
discretion, there is a doubt as to the attribution or authenticity of that property are inaccurate
in any respect.
(c) All consigned property will be sold without reserves unless reserves are mutually agreed upon
and confirmed by both parties. You agree that neither you nor any representative or agent of your
(except our authorized representatives) will bid at the sale on your consigned property,
all bids to protect your reserves, if any, will be made by our representatives as your agent.
(d) We assume no responsibility for and are under no obligation to own or otherwise enforce,
payment by any purchaser, for property sold. In the event of non-payment by the purchaser, we,
in our sold discretion, may either (i) enforce in your or our name any or all of your and our
rights against the purchaser, (ii) cancel the sale and recover and resell the property for your
account at auction or privately or (iii) cancel the sale and return the property to you.
(e) We will settle and render to you an account of the sale of consigned property on or about
five days following the day of sale with which we will remit the net proceeds received and collected
from such sale after deducting our commissions and other amounts due us hereunder, settlement and
payment as provided in this paragraph will not constitute a waiver of your obligations hereunder.
(f) We are not responsible for postponement of sale for reasons beyond our control is case of such
postponement, a new date will be determined by Vintage Auctions of Canada Ltd.
(g) Two foregoing terms and conditions shall become effective upon both parties signing this agreement.
Good must arrive freight or delivery charges prepaid. Terms and conditions shall be governed by the
laws of the province in which the auction is held.
In consideration of the agreement to act as your agent, kindly indicate your acceptance of the
forgoing by signing and forwarding to us the duplicate copy of this agreement which, together with
the Conditions of Sale, constitute the entire agreement between us and may only be changed in
writing signed by an officer of Vintage Auctions of Canada Ltd.
No credit for entry on maximum commissions.
We will not be responsible for misrepresented auto's. All misrepresented vehicles
will be returned to the consignee : We only act as your agent.
